I think both players should get the loot of eachother since they both killed eachother so it should count as a regular kill

No... How does 64% of the people on this poll vote, "Both players get each other's items".
Shouldn't it be similiar to staking?
When a duel is tied, you get to keep your items and it's optional to re-stake, or in this case, re-fight.
